Jesus Escamilla asked the question at the DOL seminar. Per the DOL the election committee cannot censor specific campaigning. The DOL advised election committees to not to do this. The DOL advised to refer to the local policy and bylaws. Once a nominee accepts nomination they will be provided with local election policy and bylaws.

I am pleased and relieved to announce that the members for the 2008. CWA Local 9421 election committee have been selected. I want to thank everyone who showed interest. I am confident and proud to have Jesus Escamilla, Danielle Tercero, and Tina Murray joining me on the committee. We also have the support of the previous Election Chair Paul Padilla as advisor. I would also like to thank the membership and the officers with trusting me with the responsibility of the Election Chair. It is my honor to continue to serve the membership of CWA Local 9421.

Frequently Asked Questions
Meant to answer general questions related to the election
With the upcoming Local Union election it is imperative that we have an effective and readily available source of information for our members. The Election Committee has compiled a list of frequently asked questions and provides a general answer to most. Not all questions can be covered, but an attempt was made to answer the most frequent ones.

All efforts will be made to respond to every question or concern.
- Why are elections held?
Title IV of the Labor-Management Reporting and Disclosure Act of 1959, as amended establishes election procedures that must be followed by all unions covered by the ACT, regardless of whether their constitution and bylaws so provide.
Article XV of the CWA Constitution as amended July 2007 requires election of officers every three years or until their successors have been duly elected and qualified.
- Who eligible to vote?
A member in good standing with a card in file by 9:00 a.m. of the day of the general membership meeting prior to the election and must have had their membership approved by that meeting.
- Who is a member in good standing?
A member with no outstanding fines and dues as specified in the local bylaws.
- How do I receive my ballot?
Ballots will be mailed to your last know address on file at least 15 days prior to the election.
- When will the election be held?
The election will be held on October 20, 2008.
- When and how are nominations going to be made?
Nominations will be accepted from the floor at the September 9, 2008 General Membership Meeting.
- Who is eligible to run for office and accept nomination for candidate?
Candidate eligibility will be in accordance with Federal Law, CWA Constitution and Local Bylaws. All candidates must be members in good standing, with all dues and fines current.
- Can I campaign for a candidate?
Yes. Any member of the local can campaign for a candidate as long as they adhere to election rules, as long as it is on your own time, not Union or Company paid time.
- Can I write additional comments on my ballot?
No. Any additional comments, marks, or colors other than black or blue ink will void the ballot.
- What if I don’t receive my ballot?
All ballots are mailed to the last address of record; if you have not updated any changes with the Union Hall, please update all information as soon as possible.
- Can a member begin to campaign prior to being nominated or accepting candidacy?
Yes. Most courts have held that a person may be a candidate for office before he/she has actually been nominated to run for that office.
- If I have questions, comments, or concerns to whom do I direct them to?

Nominations for the offices of President, Executive-Vice President, Secretary-Treasurer, 1st Vice President, 2nd Vice President, 3rd Vice President, 4th Vice President and Executive Board will be accepted from the floor at the September 2008 membership meeting.
Candidates must accept nomination by 5:00 p.m. September 10, 2008 to the election committee at the CWA Local 9421 Union Hall 2725 El Camino Ave, Sacramento, Ca 95821.
In accordance with Local 9421 by-laws all candidates for any office must be a member in good standing. All dues and fines must be current.
The election will be conducted on Monday October 20, 2008. All ballots must be into the post office by 8:00a.m. Monday October 20, 2008.

Questions for the Election Committee from the July Membership Meeting
- How was the decision reached to use an outside vendor to count votes?
The Election Committee met with officers Dee Garcia, Lupe Mercado, Denise Mack, John Adams Jr., Mike Bell, and Berta Cable and asked their opinion as which counting method they would recommend. They all agreed that the using the vendor was a more efficient option than having the election committee hand count the ballots. Clerical errors are less likely with an electronic tally. We also asked previous Election Chair Paul Padilla for his input. He agreed that is was a benefit to use the vendor.
- Which method costs more?
The Election Committee compared the costs of the previous three elections. On the surface it may seem that the vendor costs more. The 2005 Election was the first time 9421 had used an outside vendor. We have to factor in that there were unusual events in that election. The office of President was challenged and had to be re-ran. Another thing to consider is that the previous Election Committee had several elections of experience.
- Why was Election Services Solutions selected?
The Election Committee felt that it would be a benefit to maintain the services with a company we have a history with. Unfortunately all previous elections materials are either lost or destroyed. We have been very fortunate that Elections Services Solutions has maintained the documentation that has saved us from having to start completely over.
- Is Election Services Solutions a union represented company?
No they are not, but they only do business such as printing and other contracted out work with union represented companies.
- Were any of the vendors union represented?
Yes, there was one and they were represented by CWA 9586.
- Why didn’t you choose them?
Unfortunately, their reply came after the decision and the motion had been made. Also, as stated in a previous question it has proven a benefit to maintain the relationship with a vendor who has had history with our local.
- Can the Election Committee impose restrictions on the size and the amount of candidate material?
No. The Election Committee upholds the interpretation of the DOL guidelines that they cannot censor any aspect of campaigning material. We will ask the candidates to be considerate of all information that needs to be available to the membership and ask for a voluntary commitment to not obstruct the necessary information posted on the boards. We are confident that an amicable agreement will be reached in respect to the issue.

Dear Union Brothers and Sisters,
In the next few months the CWA Local 9421 2008 Elections will be under way. Nominations will take place at the membership meeting September 9, 2008 and the elections will take place October 20, 2008.
The majority of campaigning will take place during this time frame. Candidates have the right to post information on the union boards. The cooperation of this process will be imperative. It is the responsibility of the Election Committee to insure that the election process is fair and equitable to all candidates. Removal or vandalism of campaign materials hinders the proper process.
We all should be aware that there are some important issues immediately affecting our local membership. Our labor contract expires April 2009. The announcement of the closure of the NCSC (611 @ T street) and the potential removal of 187 jobs out of our local is all something we need to be conscious of.
Election challenges are very costly to the local. Some challenges are caused by unintentional actions, but all are avoidable.

Do not deface or remove campaign materials. The membership has a right to make an informed and personal decision as to which candidate they wish to vote for.
