Dates for the new election

Posted as of 9:10 am on Thursday, November 10th

Dear Member,

The dates for the new election are as follows:

Ballots will be mailed on November 29th and will be counted on Friday, December 16, 2011. Ballots must be in the PO Box by 9am in order to be counted.

Last day to submit membership cards is noon on Thursday, December 8th.

Last day to request ballots is by 5pm on Monday, December 12th.

Re-Run Notice

Regarding the Election on October 13th

Dear Member,

There will be no final certification of the 2011 General Election held on October 13, 2011. It is the final determination of the Election Committee that the election must be rerun.

Notification to Members

Regarding the Election that took place Thursday, October 13th

Dear Member,

It is the decision of the 2011 Election Committee that the General Election must be rerun. On Election Day, it was discovered that 25 of the 60 undeliverable ballots had address changes from the Post Office. Unfortunately, those address changes were not acted on. In light of this, and the narrow margin of each race, these ballots could have potentially affected the outcome of every race. Mailing dates will be announced as soon as we have them.

As mandated by our By-laws, the nominations for our Local Officers and Executive Board will take place at our September 13th Membership Meeting.

To be a candidate for office in the Local, one must be a member in good standing of this Local and express his/her desire to run by turning in a signed Acceptance of Nomination form by a pre-arranged date. The date for returning the nomination form is September 14, 2011 by 5:00pm.

We, the Election Committee, are here to run an election which is fair and impartial, with the greatest number of qualified candidates presented to the greatest number of members.

Frequently Asked Questions

Meant to answer general questions related to the election

With the upcoming election, it is imperative that we have an effective and readily available source of information for our members. The Election Committee has compiled a list of frequently asked questions and provides a general answer to most. Not all questions can be covered, but an attempt was made to answer the most frequent ones.

If you have additional questions, concerns or need general information about the upcoming election please contact the Election Committee by phone at 916-974-6911 or by e-mail at elections2011@cwalocal9421.org.  All efforts will be made to respond to every question or concern.

  1. Why are elections held?
    Title IV of the Labor-Management Reporting and Disclosure Act of 1959, as amended, establishes election procedures that must be followed by all unions covered by the Act, regardless of whether their constitution and bylaws so provide.

    Article XV of the CWA Constitution, as amended August 2011, requires election of Officers every three years or until their successors have been duly elected and qualified.


  1. Who is eligible to vote?
    A member in good standing. The last day to submit membership cards is Thursday, October 6, 2011 at 12pm (noon) Thursday, December 8, 2011 at 12pm (noon).

  1. Who is a member in good standing?
    A member with no outstanding fines and dues, as specified in the local bylaws.

  1. How do I receive my ballot?
    Ballots will be mailed to your last known address on file.

  1. When will the election be held?
    The election will be held on October 13, 2011 Friday, December 16th. Ballots must be in the PO Box by 9am in order to be counted.

  1. When and how are nominations going to be made?
    Nominations will be accepted from the floor at the September 13, 2011 General Membership Meeting.

  1. Who is eligible to run for office and accept nomination for candidacy?
    Candidate eligibility will be in accordance with Federal Law, CWA Constitution and Local bylaws.  All candidates must be members in good standing, with all dues and fines current.

  1. Can I campaign for a candidate?
    Yes.  Any member of the Local can campaign for a candidate, as long as they adhere to election rules, as long as it is on your own time, and not on Union or Company paid time. You should also be aware that the prohibition against the use of union and employer funds applies to any union and any employer, not just to CWA Local 9421 or to the employers with whom CWA Local 9421 has collective bargaining agreements.

  1. Can I write additional comments on my ballot?
    No.  Any additional comments, marks, or colors other than black or blue ink will VOID the ballot.

  1. What if I don’t receive my ballot?
    All ballots are mailed to the last address of record. If you have not received your ballot, notify the Election Committee.

  1. Can a member begin to campaign prior to being nominated or accepting candidacy?
    Yes.  Most courts have held that a person may be a candidate for office before he/she has actually been nominated to run for that office.

  2. If I have questions, comments or concerns, to whom do I direct them?
    The Election Committee will address all questions, comments or concerns after consulting Federal Law, the CWA Constitution, bylaws and Election Policy File.  The Election Committee can be reached by phone at 916-974-6911 or by e-mail at elections2011@cwalocal9421.org.
